Your data is yours.
Heliarko never receives or hosts the contents of your capsule. No one here can open it, read it, or speak in your place.
License and optional cloud features.
The local capsule is intended to stay yours and keep working offline. The living conversation and updates may be provided as separate cloud features, and they may change if the connection, provider, or testing program changes.
Open and free while we build.
During the testing phase, both the license and the optional cloud features are open and free. Payments are not accepted during testing. Commercial terms may be introduced later, and no price is published today.
Cloud and AI provider.
The living conversation requires a third-party cloud AI provider. The relay is designed not to keep anything of you permanently. Offline, the capsule is still a letter you can read and search.
Acceptable use.
Use Heliarko lawfully. Do not use it to break the law, infringe the rights of others, or attempt to breach, reverse-engineer, overload, or misuse the cloud relay, the website, or our systems beyond what the law expressly allows. The capsule on your own disk is yours to use privately; these limits concern our cloud service and website.
No warranty.
The website and optional cloud features are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free. Nothing here excludes liability that cannot be excluded by law.
Limitation of liability.
To the fullest extent permitted by law, Heliarko is not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from the website, the testing program, or optional cloud features. Mandatory liability - including for intent, gross negligence, injury to life, body or health, and under applicable consumer-protection and product-liability law - remains unaffected.
A right to a sunset.
Fifty years by default, never a sentence. You can seal the capsule, erase it, or let it quietly end whenever you choose.
What the capsule does not do.
It does not bring you back and does not pretend to be you. It is a letter in your own hand that can now listen and answer - and honest about being exactly that.
If Heliarko ever disappears.
The capsule outlives the company. Your memory, voice, and files stay on your disk and keep working offline, with us or without us.
Governing law and your rights.
These terms are governed primarily by the laws of Poland and the European Union, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Courts with jurisdiction under applicable Polish and EU law apply. If you are a consumer in the EU, you keep the mandatory protections of your country of residence. If you are a US user, nothing here removes rights you have under the consumer-protection laws of your state; mandatory local law applies where it must.
Changes to these terms.
We may update these terms as the product and the law evolve. For material changes affecting cloud features we will give reasonable notice. The capsule already on your disk keeps working regardless.
Ending use.
You may stop using optional cloud features at any time. If payments are introduced later and you do not pay, the cloud simply goes quiet and the capsule stays with you, untouched. We may suspend or end cloud features for unlawful use or where required by law, but we cannot and will not reach into your local capsule.
