Simple terms for a product still being built.

1 The public test

Heliarko 1.0.12 is a public-test release.

It is real software under active development.

It is not presented as a finished product.

Features may change. Some parts may be incomplete. Bugs may exist. Compatibility may change as the software develops.

If something important is not ready, we should say so rather than describe a future feature as if it already exists.

2 What you receive

During the public-test period, you may download and use the Heliarko personal software without paying a license fee.

One registered email receives one permanent Capsule ID, one personal capsule number and one activation code. The original issue may be followed by no more than three recovery download windows. Each window remains open for 24 hours so an interrupted download can be restarted or resumed without using another recovery; further recovery requires contacting Heliarko administration.

Only one downloaded copy of that Capsule ID may use Heliarko-operated Messenger and cloud AI at a time. Moving those online services to a replacement copy does not revoke the lifetime local license or remove local data.

No payment details are required for the public-test download.

The software is built around a personal Capsule on storage controlled by the person using it.

Optional online functions are separate from the local-first Capsule and may have their own technical requirements and future terms.

3 Founding Tester license

Arriving early should mean something.

A person who joins during the defined public-test period receives the Founding Tester benefit described publicly as a Lifetime Personal License.

The intention of this promise is simple: the personal Heliarko license granted during the public-test period is not later converted into a recurring paid license merely because Heliarko changes its commercial model.

4 Optional future services

Heliarko may later offer separate services that have real continuing costs.

Examples may include online AI, communication, hosted infrastructure or other online capabilities.

Those services may have separate prices and separate terms.

A Founding Tester’s personal license does not disappear merely because the person chooses not to buy an optional future service.

We may charge for continuing service. We do not charge a Founding Tester again merely for the right to keep the personal license already granted under the programme.

5 Your material

Your material remains your material.

You decide what to place inside your Capsule.

Using Heliarko does not transfer ownership of your photographs, documents, recordings, stories, notes or other personal material to Heliarko.

Exact technical data flows must be described consistently with the Privacy and Technology pages.

6 Keep a backup

Local control also means responsibility for local storage.

Computers fail. Drives fail. Files can be deleted. Devices can be lost or stolen.

Do not keep the only copy of something irreplaceable on a single physical device.

No software can make one physical copy indestructible.

7 Online AI

Some Heliarko functions may use an external AI service.

When such a function is used, information required to process the request may leave the local device.

What is sent, when it is sent and which service receives it should be explained according to the actual version in use.

Third-party AI providers may operate under their own applicable terms and privacy rules.

Read Privacy before using online AI with sensitive material.

8 AI can be wrong

AI-generated output may be inaccurate, incomplete or invented.

A confident sentence is not proof that something is true.

Heliarko’s philosophy distinguishes between source, context, inference and generated content.

Do not use an AI-generated answer as the sole basis for an important medical, legal, financial, safety or other high-consequence decision.

Check the source. Use human judgment. Together, not instead.

9 Your feedback

Feedback during the public test is welcome. You may tell us about:

• problems,
• confusing screens,
• missing functions,
• unexpected behaviour,
• ideas,
• or things that worked well.

If you send feedback, you allow Heliarko to use the substance of that feedback to improve the product without owing you payment or ownership in Heliarko.

You keep ownership of your own underlying material.

Please do not send private Capsule content when a simple description or privacy-safe screenshot is enough.

10 Fair use of Heliarko services

Use the website and any Heliarko-operated online services lawfully.

• Do not deliberately attack or disrupt Heliarko systems;
• attempt to gain unauthorised access;
• use online infrastructure to harm other people;
• circumvent technical safeguards protecting Heliarko services;
• or use Heliarko-operated services in violation of applicable law or the rights of others.

Nothing in these Terms is intended to remove rights that applicable law expressly gives you and does not allow to be removed by contract.

11 Heliarko software and brand

Heliarko, its software, original interface, documentation, brand assets and other original project material remain protected by applicable intellectual-property rights.

A personal software license gives a right to use the software under its terms.

It does not transfer ownership of the Heliarko project or brand.

Do not present a modified or unrelated product as an official Heliarko release.

12 Updates

Heliarko may provide updates, fixes and new versions.

Updates may change functionality as the product develops.

We do not promise that every feature will remain unchanged forever.

We also do not use the word “lifetime” to promise lifetime software development.

Any mandatory rights that applicable law gives a consumer regarding updates remain unaffected.

13 Public test availability

Some online public-test functions may occasionally be unavailable.

They may depend on internet access, infrastructure or third-party providers.

Heliarko may change or temporarily suspend an online test function for technical, security or legal reasons.

This should not be confused with converting a Founding Tester personal license into a subscription.

14 No false warranty — and no false disclaimer

We do not promise that public-test software will be free of every defect.

We do not promise uninterrupted online availability.

We do not promise compatibility with hardware, software or services that we have not identified as supported.

The website and optional online functions are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

At the same time, the words “public test” do not remove mandatory legal rights.

Nothing in these Terms is intended to exclude mandatory consumer protections or mandatory liability that applicable law does not allow to be excluded.

15 Liability

To the fullest extent permitted by law, Heliarko is not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, arising from the website, the public-test programme or optional online functions.

Mandatory liability — including for intent, gross negligence, injury to life, body or health, and under applicable consumer-protection and product-liability law — remains unaffected.

This clause preserves the liability wording already used for the test period. It is a legal-review area and must be reconsidered before paid commercial operation.

16 Stopping use

You may stop using Heliarko whenever you choose.

You may stop using optional online functions independently of your own local material.

Heliarko may restrict access to Heliarko-operated online services where reasonably necessary because of abuse, security, law or serious breach of applicable service terms.

A change in commercial model alone does not convert an existing Founding Tester personal license into a recurring subscription.

17 Changes to these Terms

These Terms may need to change as the product, services and law develop.

A new version should show its effective date.

Material changes should be explained clearly rather than silently inserted into old text.

A later change should not be used merely to turn an existing Founding Tester personal license into a recurring paid license.

Future optional services may have their own terms.

18 Governing law and consumer rights

These Terms are governed primarily by the laws of Poland and the European Union, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Courts with jurisdiction under applicable Polish and EU law apply.

If you are a consumer in the EU, you keep the mandatory protections of your country of residence. If you are a user elsewhere, nothing here removes rights that mandatory local consumer-protection law gives you.

This clause preserves the existing Polish/EU legal basis used for the public-test period, and must be revisited when the operator migrates to Germany.
